Terms of service

1. Who we are

Menu Sentry is a trading name of Thomas Ball. Contact: menu.sentry@gmail.com.

2. Business customers only

Menu Sentry is for businesses. By signing up you confirm that you are buying for the purposes of your business and that you have authority to agree these terms for it.

3. The service

We aim to send you a weekly email listing changes we find to the prices and dishes on the public online menus of the competitors you choose. We provide the service with reasonable care and skill. We read the web pages and PDF menus that competitors publish, and we respect applicable website access instructions, including robots.txt where applicable.

4. Third-party websites

Menu Sentry monitors information published on third-party websites. We do not control those websites and cannot guarantee that they will remain available, accessible, accurate or unchanged. We do not guarantee that our collection or reporting will identify every change made by a third party.

If a competitor blocks access, changes its site or removes its menu, we may be unable to report on it. We will tell you if a competitor's menu cannot be read.

5. What we do not promise

We do not promise that every change will be found, that a report will arrive on a particular day or at a particular time, that the service will be uninterrupted or free of errors, or that the information on a competitor's menu is itself correct.

The service also depends on the email systems of you and your provider, and on the payment, hosting and email companies we use.

6. If a report is late or missed

If we cannot send a report on time, we will send it as soon as we reasonably can and, where we can, tell you why. If we send you no report at all for a whole billing month for reasons within our control, we will refund that month's payment. Section 14 explains how this affects our liability.

7. Price and billing

The price is £40 per month. It is charged monthly in advance by card through Stripe and renews automatically until you cancel. If a payment fails, we may pause your reports until it is paid. We will give you at least 30 days' notice by email before any price increase, and you can cancel before it takes effect.

8. Cancelling

You can cancel at any time by replying to a report email or writing to menu.sentry@gmail.com. We will confirm your cancellation by email.

You keep access to the service until the end of your current paid billing period. Cancelling stops the next renewal. Unless these terms say otherwise or the law requires a refund, payments already made for the current billing period are not refundable.

9. Other refunds

Apart from the refunds in sections 6, 10 and 15, payments are not refunded, except where the law requires it.

10. Pausing, changing and ending the service

We may pause the service for a short time for maintenance or security work, and will try to tell you first where we can. We may pause your reports if a payment fails. We may end your service straight away if you seriously break these terms. We may also stop offering the service by giving you at least 30 days' notice. If we end the service for any reason other than your breach, we will refund any payment for a period after the service ends.

12. Reports are information, not advice

We take reasonable care, but a report may contain errors or leave something out, for example when a competitor changes the layout of its page. Check anything important on the competitor's own menu before you act on it. Pricing and menu decisions are yours.

13. Intellectual property, licence and confidentiality

We own or have the right to use the software, website, branding and materials we provide as part of Menu Sentry, including the way reports are presented. We do not claim ownership of information that comes from competitors' websites.

During your subscription, we give you a non-exclusive, non-transferable licence to use the reports internally for your business. You must not resell, redistribute or commercially republish them, and you must not share them outside your business.

We will keep the list of competitors you ask us to watch confidential. We may disclose it to service providers who need it to provide the service, and where the law requires us to.

14. Limits on our liability

15. Events outside our control

We are not responsible for a delay or failure caused by events outside our reasonable control. These include power or internet failures, outages at our hosting, email or payment providers, cyber attacks, and changes to or blocking by competitors' websites. If such an event stops the service for more than 30 days, either of us may cancel, and we will refund any payment for a period you have paid for but not received.

16. Privacy and your data

We handle personal data in line with our privacy notice. After your subscription ends, we may keep information where reasonably necessary for legal, accounting or legitimate business purposes, in line with that notice.

17. Changes to these terms

We may change these terms or the service. We will tell you by email before a change that affects you takes effect. Price increases need at least 30 days' notice, as set out in section 7.

18. Questions and complaints

If you have a problem or a complaint, email menu.sentry@gmail.com. We will look into it and reply as soon as we reasonably can.

19. General

These terms are the whole agreement between you and us about the service. Only you and we can enforce them. If any part is found to be unenforceable, the rest still applies. The law of England and Wales applies, and the courts of England and Wales have jurisdiction.
